Terms of Service

These Terms of Service ("Terms") govern your use of the ATTICO CASA website and the quotation, ordering, and supply of furniture products through us. By using this website, submitting an inquiry, or placing an order, you agree to these Terms. If you do not agree, please do not use the website or our services.

1. Use of the Website

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of, the website by anyone else. Unauthorized attempts to interfere with the website, bypass security measures, or access non-public systems are prohibited.

2. Quotations and Pricing

• Unless otherwise stated in writing, all quotations are valid for 30 days from the quotation date;
• Prices are quoted in the agreed currency and are based on specifications, materials, quantities, and Incoterms stated in the quotation;
• Prices are subject to change after expiry, or where raw material, exchange-rate, freight, or regulatory costs change materially;
• A quotation does not constitute an offer capable of acceptance; a binding contract is formed only when we issue a written order confirmation or pro forma invoice accepted by you.

3. Minimum Order and Samples

Minimum order quantities (MOQ) apply depending on the product and whether production is standard, made-to-order, or private label. Samples may be chargeable; sample fees and freight are paid by the buyer unless otherwise agreed. Sample arrangements, including fee refund policy for subsequent bulk orders, are confirmed in writing case by case.

4. Orders, Payment, and Production

• Orders are accepted on the basis of the confirmed pro forma invoice, including product specifications, quantities, packaging, labels, price terms, and delivery schedule;
• Unless otherwise agreed, payment is made by telegraphic transfer (T/T), with a deposit due before production begins and the balance paid against the copy of shipping documents before release;
• Production begins after deposit confirmation and final approval of samples/production details;
• Order changes requested after production starts may not be possible and may incur additional costs.

5. Lead Times and Delivery

Lead times stated in quotations or order confirmations are estimates and begin when production prerequisites (deposit and approved details) are complete. We are not liable for delays caused by force majeure, material shortages, carrier delays, customs clearance, or delays attributable to the buyer. Unless otherwise agreed, goods are delivered under the Incoterms specified in the order confirmation.

6. Risk and Title

Risk passes to the buyer in accordance with the agreed Incoterms. Legal title to the goods remains with us until full payment has been received. The buyer is responsible for import clearance, duties, taxes, and compliance with the regulations of the destination country.

7. OEM, ODM, and Private Label

Where goods are produced under OEM/ODM or private-label arrangements: the buyer warrants that any logos, artwork, designs, specifications, or materials it supplies do not infringe third-party intellectual property rights, and indemnifies us against related claims. Our trademarks, product designs, tooling, and proprietary specifications may not be used or reproduced without our written consent.

8. Product Information

Product images, dimensions, colours, finishes, and specifications on this website are indicative and may differ from the final product due to screen settings, materials, craftsmanship, and continuous product improvement. Definitive specifications are those stated in the order confirmation and approved samples.

9. Inspection and Warranty

We conduct quality control before shipment. Claims for damage, defects, or shortages must be notified within 7 days of delivery, with photographs and supporting details, and before any further processing or resale of the goods. Verified manufacturing defects will be remedied by repair, replacement, credit, or refund at our discretion. Damage caused by transport, improper storage, assembly, use, or normal wear is excluded.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order shall not exceed the amount paid for the products giving rise to the claim. We are not liable for indirect or consequential losses, including loss of profit, business, or goodwill, except where such exclusion is not permitted by law.

11. Third-Party Links and Services

This website may contain links to third-party websites or services. We are not responsible for the content, availability, or practices of third parties, and your use of them is at your own risk.

12. Governing Law and Disputes

These Terms and any contract between us are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. The parties will first seek to resolve disputes amicably; unresolved disputes will be submitted to the competent people's court or arbitration institution in Foshan, Guangdong, China, unless otherwise agreed in writing.

13. Changes

We may revise these Terms from time to time. The current version applies to new inquiries and orders, and material changes will be communicated where appropriate.
